Following terms and conditions (the “Terms and Conditions”) shall apply to the Free Nokia Bluetooth Headphones - 205 with Nokia G 42 (6/128) (“Offer”) detailed below. This Free Bluetooth Headphones Offer is offered by HMD Mobile India Private Limited (“HMD” or “Organizer”).

1. The Offer shall be valid from 21st January 2024 until stocks last (“Offer Period”). This Offer is valid for first 200 purchases of Nokia G 42 (6/128) on https://www.nokia.com/phones/en_in (“Ncom”) only.

2. Under this Offer the first two hundred (200) consumers who make a valid and legal purchase of a brand-new Nokia G42 (6/128) mobile phone only from Nokia.com (“Ncom”) shall get a Nokia Bluetooth Headphones - 205 (“Free Nokia Bluetooth Headphones”) free with their purchase. This is a limited validity introductory offer and valid only for first 200 purchases made online through Ncom.

3. The Nokia BH - 205 shall be dispatched along with purchased Nokia G42 (6/128) for the first 200 consumers as a part of Offer and shall be delivered at the same address as specified by the consumer during his purchase of Nokia G 42 (6/128).

4. In the event the consumer returns the purchased Nokia G42 (6/128) then the free Nokia BH - 205 is also required to be returned. Failing to return the Free Nokia Bluetooth Headphones shall enable HMD to take any actions it deems fit against the consumer which shall include but not be limited to rejection of return request for the purchased Nokia G42 (6/128). Other terms of refund/return/ cancellation shall apply.

5. This Offer is subject to fulfilment of terms and conditions of purchase by the consumer only.

6. This Offer is subject to local availability. HMD reserves the right to alter, amend, extend, withdraw, discontinue, or otherwise change the offer/offers anytime during the offer period without any liability to the consumers.

7. Subject to any applicable law: (a) All warranties of any kind whatsoever, whether express or implied, are hereby expressly disclaimed by HMD including, but not limited to, meeting of the consumer's requirements or aspirations, timeliness, security, the results or reliability of the Free Nokia Earbuds Offer, or the delivery, quality, quantity, merchantability, fitness for use or non-infringement in respect of any Nokia products received under this offer (b) The consumer expressly agrees that his/her participation in this Offer is at the consumer's sole risk and is governed by the Terms and Conditions herein; and (c) No advice or information whether by representations, oral, written or pictorial derived from the website or through this Offer shall be construed to mean the giving of any warranty of any kind by HMD.

8. By claiming this Offer, consumers understand that any personal data relating to the consumers who Claim this Offer will be used solely in accordance with current data protection legislation and the HMD Privacy Policy- https://www.nokia.com/phones/en_int/privacyportal.

9. This Offer shall be governed by and construed in accordance with the laws of New Delhi. Any disputes, differences and, or, any other matters in relation to and arising out of the Offer and, or, pertaining to the Terms and Conditions shall be referred to arbitration. The arbitral tribunal shall consist of a sole arbitrator to be appointed by the Organizer.

10. HMD will not accept any liability or responsibility for any damage, loss, injury or disappointment suffered by any consumer as a result of claiming the Offer.

11. This Offer is non-transferable and cannot be clubbed with the benefits under any other Contest, Offer or Competition organized by HMD. This Offer cannot be exchanged for cash or kind, and no such requests will be entertained.
