#HMDFusionXVenom:The Last Dance Competition Terms and Conditions
Following terms and conditions (the “Terms and Conditions”) shall apply to the Competition #HMDFusionXVenom:The Last Dance (the ‘’Competition”) detailed below. For the purposes of these Terms and Conditions, the term Organizer, when used with reference to a legal entity, shall mean HMD Global Oy (“Organizer”).
Eligibility
Competition is open only to those who follow HMD.finland pages on Instagram and comment with “#VENOM” on the HMD post about this Competition and who are 18 years old as of the date of entry (“Participant”). The Competition is only open to legal residents of the Finland and is void where prohibited by law. Employees of Organizer, their respective affiliates, subsidiaries, advertising and promotion agencies, suppliers and their immediate family members and/or those living in the same household of each are not eligible to participate in the Competition. The Competition is subject to all applicable federal, state and local laws and regulations.
Competition Rules
By participating, the Participant agree to be fully unconditionally bound by these Rules, and the Participant represent and warrant that he/she meets the eligibility requirements set forth herein. In addition, you agree to accept the decisions of Organizer, as final and binding as it relates to the content.
Competition Period
Entries will be accepted online starting on 28th November 12:00 EET (GMT +2) 2024 until 4th December 23:59 EET (GMT +2h)
How to Participate
The Competition must be entered by commenting #VENOM to the post about the HMD Fusion and movie tickets giveaway and also by following @HMD.finland on Instagram. The entry must fulfil all Competition requirements, as specified, to be eligible to win a prize. Entries that are not complete or do not adhere to the rules or specifications may be disqualified at the sole discretion of Organizer. Participant may enter as many times as they like. If Participant uses fraudulent methods or otherwise attempt to circumvent the rules, Participant’s submission may be removed from eligibility at the sole discretion of Organizer.
Prizes
1 lucky winner from Finland will receive a HMD Fusion device and two movie tickets to Finnkino Theatres.
De specifieke details van de prijs worden bepaald door de organisator. Vervanging in contant geld of een andere prijs is niet toegestaan, behalve naar goeddunken van de organisator. De prijs is niet-overdraagbaar. Alle eventuele prijsgerelateerde kosten, met inbegrip van, doch zonder beperking tot alle eventuele federale, staats- en/of lokale belastingen, vallen onder de verantwoordelijkheid van de winnaar. Vervanging van de prijs of overdracht/toewijzing van de prijs aan anderen of een verzoek door de winnaars om het equivalent in geld te ontvangen is niet toegestaan. Aanvaarding van de prijs omvat toestemming voor de Organisator om de naam, de welwillendheid en de deelname van de winnaar te gebruiken met het oog op commerciële doeleinden, zonder verdere compensatie, tenzij dit wettelijk verboden is. De winstkansen zijn afhankelijk van het aantal in aanmerking komende inzendingen.
Winner selection and notification
Winners of the Competition will be selected in a random drawing under the supervision of the Organizer. Winners will be notified by Direct Message within five (5) days following the winner selection. Organizer shall have no liability for a winner's failure to receive notices due to winners' spam, junk e-mail or other security settings or for winners' provision of incorrect or otherwise non-functioning contact information. If the selected winner cannot be contacted, is ineligible, fails to claim the prize within 5 days from the time award notification was sent, or fails to timely return a completed and executed declaration and releases as required, prize may be forfeited and an alternate winner selected. Rights Granted by Participant
Door deelname aan deze Wedstrijd begrijpt u dat de Organisator zonder verdere kennisgeving, beoordeling of toestemming uw inzending wereldwijd mag afdrukken, publiceren, uitzenden, distribueren en gebruiken in alle media, inclusief, maar niet beperkt tot, de naam, het portret, de foto, de stem, de beeltenis, de afbeelding of verklaringen over de Wedstrijd, publiciteit of informatie over de inzending en de winnaar, evenals voor commerciële, advertentie-, PR- en promotionele doeleinden zonder verdere compensatie.
Changes
De Organisator behoudt zich het recht voor om naar eigen goeddunken de Wedstrijd te annuleren, beëindigen, wijzigen of op te schorten indien er een virus of bugs, niet-toegestane menselijke interventie, fraude of andere zaken plaatsvinden die buiten zijn controle liggen en die het beheer, de beveiliging, eerlijkheid of een goede uitvoering van de Wedstrijd in de weg staan of beïnvloeden.
Limitation of Liability
Door deelname gaat u ermee akkoord om de Organisator en zijn dochterondernemingen, aangesloten bedrijven, reclame- en promotiebureaus, partners, vertegenwoordigers, agenten, opvolgers, rechtverkrijgenden, werknemers, functionarissen en directeuren te vrijwaren van alle aansprakelijkheid, ziekte, letsel, overlijden, verlies, rechtszaken, claims of schade die direct of indirect kan ontstaan, al dan niet veroorzaakt door nalatigheid, als gevolg van (i) de deelname door de deelnemer aan de Wedstrijd en/of diens acceptatie, bezit, gebruik of misbruik van een prijs of een deel daarvan, (ii) technische storingen van welke aard dan ook, inclusief maar niet beperkt tot het niet functioneren van een computer, kabel, netwerk, hardware of software; (iii) het niet beschikbaar of ontoegankelijk zijn van transmissies of telefoon- of internetservices; (iv) onbevoegde menselijke tussenkomst in enig onderdeel van het inzendproces of de Promotie; (v) elektronische of menselijke fouten die zich kunnen voordoen bij de administratie van de Promotie of de verwerking van inzendingen.
Privacy Policy
Any personal data relating to this Competition shall be processed in accordance with HMD Privacy Policy.
Disputes
This Competition is governed by the laws of Finland. You irrevocably agree that Finnish courts shall have the exclusive jurisdiction. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys' fees, other than participant's actual out-of-pocket expenses (i.e. costs associated with entering this Competition), and participant further waives all rights to have damages multiplied or increased.
