1. Introduction

1.1 Applicable Terms: These HMD Fuse HarmBlock+ Subscription Terms for Australia (“Terms”) set out the conditions that apply to your subscription to the HarmBlock+ service (“Service”) provided by HMD Global Oy (“HMD”, “we”, “us” or “our”) under the Service Terms for HarmBlock+. In the event of a conflict between these Terms and the Service Terms for HarmBlock+, these Terms will prevail.

1.2 Initial Term: Your purchase of HMD Fuse device includes the Service for a 12-month period starting from the date of activation of the Service (the “Initial Term”). Your subscription is non-refundable during the Initial Term.

1.3 Paid Subscription After Initial Term: Following the Initial Term, a paid subscription with HMD is required to continue using the Service. Sections 2.-4. of these Terms apply to such paid subscription.

2. Subscription Details

2.1 Fees: The subscription fee is AU$24.95 per month, inclusive of GST.

2.2 Service Description: The Service combines parental control features – such as apps controls, location tracking, contact whitelisting and school and bedtime modes – and the HarmBlock AI, which helps to prevent the viewing, creation, and sharing of nude imagery. 2.3 Subscription Duration: Your subscription will continue on a monthly basis until you cancel it in accordance with these Terms.

3. Cancellation

You may cancel your subscription at any time by contacting HMD support at https://www.hmd.com/support. Cancellation will take effect at the end of your current billing period and you will continue to have access to the Service until the billing period concludes. Payments for the current billing period are non-refundable, and no partial refunds will be issued for unused portions of the Service.

4. Payment and Fee Adjustments

4.1 Billing Cycle: The subscription fee will be charged monthly in advance, on the same date each month as your initial subscription activation.

4.2 Payment Method: Payment must be made by a valid Mastercard or Visa credit/debit card, or through a third-party payment provider accepted by HMD. By subscribing, you authorise HMD or the third-party payment provider to charge your chosen payment method on a recurring monthly basis.

You are responsible for ensuring your payment method is valid and has sufficient funds for each billing cycle. If a payment fails, HMD may suspend or terminate your access to the Service until payment is successfully processed.

4.3 Fee Adjustments: HMD reserves the right to adjust the subscription fees. Any fee adjustment will be communicated to you via in-app notifications and/or email, at least 30 days in advance before the change takes effect.

5. Amendments

Subject to section 4.3. of these Terms, HMD may modify these Terms at any time without prior notice. If the Terms are changed in a material, adverse way, HMD will provide a separate notice advising of the change. You are responsible for regularly reviewing the Terms. Your continued use of the Service constitutes your consent to any changes and modifications.
