#HMDFusionXVenom:The Last Dance Competition Terms and Conditions
Following terms and conditions (the “Terms and Conditions”) shall apply to the Competition #HMDFusionXVenom:The Last Dance (the ‘’Competition”) detailed below. For the purposes of these Terms and Conditions, the term Organizer, when used with reference to a legal entity, shall mean HMD Global Oy (“Organizer”).
Eligibility
Competition is open only to those who follow HMD.finland pages on Instagram and comment with “#VENOM” on the HMD post about this Competition and who are 18 years old as of the date of entry (“Participant”). The Competition is only open to legal residents of the Finland and is void where prohibited by law. Employees of Organizer, their respective affiliates, subsidiaries, advertising and promotion agencies, suppliers and their immediate family members and/or those living in the same household of each are not eligible to participate in the Competition. The Competition is subject to all applicable federal, state and local laws and regulations.
Competition Rules
By participating, the Participant agree to be fully unconditionally bound by these Rules, and the Participant represent and warrant that he/she meets the eligibility requirements set forth herein. In addition, you agree to accept the decisions of Organizer, as final and binding as it relates to the content.
Competition Period
Entries will be accepted online starting on 28th November 12:00 EET (GMT +2) 2024 until 4th December 23:59 EET (GMT +2h)
How to Participate
The Competition must be entered by commenting #VENOM to the post about the HMD Fusion and movie tickets giveaway and also by following @HMD.finland on Instagram. The entry must fulfil all Competition requirements, as specified, to be eligible to win a prize. Entries that are not complete or do not adhere to the rules or specifications may be disqualified at the sole discretion of Organizer. Participant may enter as many times as they like. If Participant uses fraudulent methods or otherwise attempt to circumvent the rules, Participant’s submission may be removed from eligibility at the sole discretion of Organizer.
Prizes
1 lucky winner from Finland will receive a HMD Fusion device and two movie tickets to Finnkino Theatres.
Prisspecifikationerna bestäms endast av arrangören. Priset kan inte bytas mot kontanter eller mot ett annat pris, förutom enligt arrangörens gottfinnande. Priset kan inte överlåtas. Alla kostnader relaterade till priser, inklusive utan begränsning alla federala, statliga och/eller lokala skatter, är vinnarens ansvar. Det är inte tillåtet att byta ut priset eller överföra/överlåta priset till någon annan, eller att begära pengar i stället för priset. Vinnarens mottagande av priset innebär samtycke till att organisatören använder vinnarens namn, utseende och tävlingsbidrag för reklam och handel utan ytterligare kompensation, såvida det inte är förbjudet enligt lag. Oddsen för att vinna beror på antalet mottagna behöriga bidrag.
Winner selection and notification
Winners of the Competition will be selected in a random drawing under the supervision of the Organizer. Winners will be notified by Direct Message within five (5) days following the winner selection. Organizer shall have no liability for a winner's failure to receive notices due to winners' spam, junk e-mail or other security settings or for winners' provision of incorrect or otherwise non-functioning contact information. If the selected winner cannot be contacted, is ineligible, fails to claim the prize within 5 days from the time award notification was sent, or fails to timely return a completed and executed declaration and releases as required, prize may be forfeited and an alternate winner selected. Rights Granted by Participant
Genom att delta i denna tävling intygar du att du förstår att arrangören utan ytterligare meddelande, granskning eller samtycke kan trycka, publicera, sända, distribuera och använda, över hela världen i alla medier, ditt bidrag, inklusive men inte begränsat till bidraget och vinnarens namn, porträtt, bild, röst, likhet, foto eller uttalanden om tävlingen, publicitet eller information och för handels-, reklam-, PR- och marknadsföringsändamål utan ytterligare ersättning.
Changes
Arrangören förbehåller sig rätten att, efter eget gottfinnande, avbryta, avsluta, modifiera eller pausa tävlingen i händelse av att virus, buggar, obehörigt mänskligt ingripande, bedrägeri eller andra orsaker som ligger utanför dess kontroll skadar eller påverkar administrationen av, säkerheten för, rättvisan i eller det korrekta genomförandet av tävlingen.
Limitation of Liability
Genom att delta samtycker du till att friskriva och hålla skadelöst arrangören och dess närstående bolag, reklam- och marknadsföringsbyråer, partners, representanter, ombud, efterträdare, konsulter, anställda, befattningshavare och styrelseledamöter från allt ansvar för sjukdom, skada, död, förlust, tvist, anspråk eller skadestånd som kan uppstå, direkt eller indirekt, oavsett om det orsakats av vårdslöshet eller inte, genom (i) deltagares deltagande i tävlingen och/eller dennes mottagande, innehav, användning eller missbruk av något pris eller någon del därav; (ii) tekniska fel av något slag, inklusive men inte begränsat till funktionsfel hos någon dator, kabel, nätverk, hårdvara eller programvara; (iii) överföringars eller telefon- eller internettjänsters otillgänglighet eller onåbarhet; (iv) obehörigt mänskligt ingripande i någon del av deltagandeprocessen eller tävlingen; (v) elektroniska eller mänskliga fel som kan inträffa vid administrering av tävlingen eller behandling av inskickade bidrag.
Privacy Policy
Any personal data relating to this Competition shall be processed in accordance with HMD Privacy Policy.
Disputes
This Competition is governed by the laws of Finland. You irrevocably agree that Finnish courts shall have the exclusive jurisdiction. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys' fees, other than participant's actual out-of-pocket expenses (i.e. costs associated with entering this Competition), and participant further waives all rights to have damages multiplied or increased.
