#HMDFusionXVenom:The Last Dance Competition Terms and Conditions
Following terms and conditions (the “Terms and Conditions”) shall apply to the Competition #HMDFusionXVenom:The Last Dance (the ‘’Competition”) detailed below. For the purposes of these Terms and Conditions, the term Organizer, when used with reference to a legal entity, shall mean HMD Global Oy (“Organizer”).
Eligibility
Competition is open only to those who follow HMD.finland pages on Instagram and comment with “#VENOM” on the HMD post about this Competition and who are 18 years old as of the date of entry (“Participant”). The Competition is only open to legal residents of the Finland and is void where prohibited by law. Employees of Organizer, their respective affiliates, subsidiaries, advertising and promotion agencies, suppliers and their immediate family members and/or those living in the same household of each are not eligible to participate in the Competition. The Competition is subject to all applicable federal, state and local laws and regulations.
Competition Rules
By participating, the Participant agree to be fully unconditionally bound by these Rules, and the Participant represent and warrant that he/she meets the eligibility requirements set forth herein. In addition, you agree to accept the decisions of Organizer, as final and binding as it relates to the content.
Competition Period
Entries will be accepted online starting on 28th November 12:00 EET (GMT +2) 2024 until 4th December 23:59 EET (GMT +2h)
How to Participate
The Competition must be entered by commenting #VENOM to the post about the HMD Fusion and movie tickets giveaway and also by following @HMD.finland on Instagram. The entry must fulfil all Competition requirements, as specified, to be eligible to win a prize. Entries that are not complete or do not adhere to the rules or specifications may be disqualified at the sole discretion of Organizer. Participant may enter as many times as they like. If Participant uses fraudulent methods or otherwise attempt to circumvent the rules, Participant’s submission may be removed from eligibility at the sole discretion of Organizer.
Prizes
1 lucky winner from Finland will receive a HMD Fusion device and two movie tickets to Finnkino Theatres.
Præmiens specifikationer bestemmes udelukkende af arrangøren. Ingen kontant eller anden præmieerstatning er tilladt bortset fra efter arrangørens skøn. Præmien kan ikke overføres. Alle præmierelaterede udgifter, inklusive og uden begrænsning, alle føderale, statslige og/eller lokale skatter og moms er vinderens eget ansvar. Ingen erstatning af præmie eller overførsel/tildeling af præmie til andre eller anmodning om tilsvarende kontanter af vindere er tilladt. Modtagelse af præmien udgør arrangørens tilladelse til at bruge vinderens navn, lighed og bidrag til reklame- og handelsformål uden yderligere kompensation, medmindre det er forbudt ved lov. Oddsene for at vinde afhænger af antallet af berettigede tilmeldinger, der modtages.
Winner selection and notification
Winners of the Competition will be selected in a random drawing under the supervision of the Organizer. Winners will be notified by Direct Message within five (5) days following the winner selection. Organizer shall have no liability for a winner's failure to receive notices due to winners' spam, junk e-mail or other security settings or for winners' provision of incorrect or otherwise non-functioning contact information. If the selected winner cannot be contacted, is ineligible, fails to claim the prize within 5 days from the time award notification was sent, or fails to timely return a completed and executed declaration and releases as required, prize may be forfeited and an alternate winner selected. Rights Granted by Participant
Ved at deltage i denne konkurrence forstår du, at arrangøren uden yderligere varsel, gennemgang eller samtykke kan trykke, offentliggøre, udsende, distribuere og bruge dit bidrag over hele verden i alle medier, herunder, uden begrænsning, bidraget og vinderens navn, portræt, foto, stemme, lighed, billede eller udtalelser om konkurrencen, omtale eller oplysninger og til handel, reklame, PR og salgsfremmende formål uden yderligere kompensation.
Changes
Arrangøren forbeholder sig ret til efter eget skøn at annullere, tilendebringe, ændre eller suspendere konkurrencen skulle (efter eget skøn) en virus, fejl, ikke-autoriseret menneskelig indgriben, svindel eller andre årsager uden for dens kontrol korrumpere eller påvirke administrationen, sikkerheden, retfærdigheden eller korrekt gennemførelse af konkurrencen.
Limitation of Liability
Ved at deltage accepterer du at frigøre og holde arrangøren og dets datterselskaber, tilknyttede virksomheder, reklamebureauer, partnere, repræsentanter, agenter, efterfølgere, beskikkede, medarbejdere, funktionærer og direktører skadesløse fra ethvert ansvar, sygdom, skade, død, tab, sagsanlæg, reklamation eller skadeserstatning, der kan opstå direkte eller indirekte, uanset om det skyldes uagtsomhed eller ej, fra (i) en sådan deltagers deltagelse i konkurrencen og/eller hans/hendes accept, besiddelse, brug eller misbrug af nogen præmie eller nogen del af denne; (ii) tekniske fejl af nogen art, herunder men ikke begrænset til funktionsfejl i en computer, kabel, netværk, hardware eller software; (iii) utilgængelighed af transmissioner eller telefon- eller internettjenester; (iv) uautoriseret menneskelig indblanding i nogen del af deltagelsesprocessen eller konkurrencen; (v) elektroniske eller menneskelige fejl, der kan forekomme i administrationen af konkurrencen eller behandlingen af bidrag.
Privacy Policy
Any personal data relating to this Competition shall be processed in accordance with HMD Privacy Policy.
Disputes
This Competition is governed by the laws of Finland. You irrevocably agree that Finnish courts shall have the exclusive jurisdiction. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys' fees, other than participant's actual out-of-pocket expenses (i.e. costs associated with entering this Competition), and participant further waives all rights to have damages multiplied or increased.
